By accessing or using the Real Horizons website and services ("Service"), which is operated by GastroSpectra Private Limited, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Age Requirement: You must be at least 16 years of age to use this Service. By creating an account, you represent and warrant that you are at least 16 years old. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. We do not knowingly collect or solicit information from anyone under the age of 16.
You agree not to use the Service to upload, publish, or share any content that:
We reserve the right to remove any content that violates this policy and to suspend or terminate accounts that repeatedly or egregiously violate these terms, with or without prior notice.
a. User Ownership: You retain full ownership and intellectual property rights to any 3D models, tours, files, or other content you upload ("User Content"). Real Horizons does not claim any ownership rights over your User Content.
b. Limited License to Host: By uploading User Content, you grant Real Horizons a limited, worldwide, non-exclusive, royalty-free license solely to host, store, display, and reproduce your User Content as necessary to provide the Service to you and your designated viewers. We will not use your User Content for any other purpose, including marketing, promotional materials, or AI model training, without your explicit written consent.
c. User Responsibility: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and share the User Content you upload. You are solely responsible for ensuring compliance with all applicable laws, regulations, and intellectual property rights. Real Horizons is not liable for any copyright infringement or legal issues arising from your User Content.
d. Platform License: Permission is granted to temporarily access and use the materials (information or software) on Real Horizons' website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.
a. Credits & Plan Entitlements: The Service may include virtual credits ("Credits") used for compute and export workloads. Credits are not real money, do not have monetary value, cannot be redeemed for cash, and are non-transferable except where required by law. Credits may be issued as promotional credits, recurring subscription credits, or purchased top-up credits. Subscription credits may reset, expire, or be capped according to your plan terms, including any rollover cap. Purchased top-up credits expire 1 year after purchase unless we state otherwise at the time of sale. Hosting entitlements, including limits on active tours, storage, branding, and analytics, are governed by your subscription plan rather than your credit balance.
b. Subscriptions & Payment Processing: Paid subscriptions are billed in advance on a recurring basis through Dodo Payments or our then-current payment processor. Self-serve billing actions, including subscription checkout, plan changes, cancellation scheduling, and customer portal access, may be handled through that provider. Except as required by law, fees already paid for the current billing period are non-refundable.
c. Usage Limits & Additional Purchases: We reserve the right to enforce usage limits on storage, active tours, analytics access, compute workloads, exports, bandwidth, and API calls. If you exceed the limits of your plan or exhaust available Credits, we may throttle or limit affected features, require you to purchase additional Credits, require you to change plans, or prevent further usage until limits reset. We will not impose additional paid charges without disclosing them to you at the point of purchase or plan change.
d. Credits Upon Termination: Upon account termination, whether initiated by you or by us, any remaining promotional, subscription, or purchased top-up Credits may be forfeited and are not refundable except as required by law. Termination also ends access to subscription entitlements and hosted-service benefits as of the effective termination or cancellation date.
Our Service integrates with third-party providers, including payment and billing providers (such as Dodo Payments), cloud infrastructure and security providers, mapping providers (e.g., Google Maps, Mapbox), analytics providers, and AI processing services. Your use of integrated third-party features is subject to the terms, privacy practices, and availability of those third parties.
Dynamic Restrictions: Usage limits for AI generation and mapping services are subject to change based on provider constraints and fair use policies. We reserve the right to dynamically adjust these limits or restrict access to specific features to ensure platform stability and prevent abuse.
The materials on Real Horizons' website are provided on an 'as is' basis. Real Horizons makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Accuracy: The 3D models and spatial data displayed on the platform are for visualization purposes. While we strive for precision, these models may not represent exact real-world dimensions or conditions.
We do not guarantee that the Service will be uninterrupted, secure, or error-free. 3D rendering and spatial processing are complex tasks; occasional failures or artifacts may occur. We are not liable for any data loss or service interruptions.
In no event shall Real Horizons or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Real Horizons' website.
You agree to indemnify, defend, and hold harmless Real Horizons, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.
a. Termination by Us: We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will immediately cease.
b. Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon your request, we will delete your account and associated User Content within 30 days, subject to any data we are required to retain for legal, regulatory, or audit purposes.
c. Effect of Termination: Upon termination of your account (by either party), your license to use the Service terminates immediately. Any remaining credits or unused subscription time will be forfeited. We may retain de-identified or aggregated data that does not identify you personally.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on our website or sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion.
Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
a. Informal Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@realhorizons.ai. We will attempt to resolve the dispute informally within 30 days.
b. Arbitration: If informal resolution is not successful, any disputes arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be New Delhi, India. The language of the arbitration shall be English.
Real Horizons shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or telecommunications failures, third-party service provider outages (including cloud hosting, GPU processing, or payment providers), cyberattacks, or power failures.
These terms and conditions are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, you irrevocably submit to the exclusive jurisdiction of the courts located in New Delhi, India.
